The short version

These Featured Listing Terms (“Featured Terms”) are an agreement between the operator of WestchesterKidsSports.com (the “Site”) (“we,” “us” or “our”), and the business that purchases a Featured listing (the “Advertiser” or “you”). They apply in addition to our Terms of Use; if the two conflict about a Featured listing, these Featured Terms control. You accept these Featured Terms when you tick the agreement box on our claim form or complete payment. The person who accepts confirms that they are authorized to bind the Advertiser.
1. Eligibility and verification
Featured listings are available to the owner of a listed program, or someone authorized to act for it. Before a Featured listing goes live we verify the request — usually by contacting the program using its publicly listed phone number, email or website. We may decline any request before activation for any lawful reason; if we decline after you have paid, we will refund you in full.
2. What Featured includes
- Top placement on the sport and town pages where your program is listed, a “Featured” badge, and the option to show a photo, description, age range and a “Sign up” button linking to your registration page.
- Placement. Featured listings appear ahead of non-Featured listings on the sport and town pages where your program is listed and in the homepage directory. If more than one Featured listing appears in the same place, we decide their order (currently alphabetical). Featured placement is not exclusive unless we agree otherwise in writing.
- Timing. We aim to publish your Featured listing within one business day after verification and payment, once you've sent us your details.
- We may change the design or layout of the Site from time to time, provided Featured listings continue to receive priority placement and a “Featured” label.
3. No guaranteed results
We do not guarantee any level of traffic, views, clicks, calls, inquiries, enrollments, revenue or search-engine ranking, or that the Site will be available without interruption. Occasional downtime for maintenance or reasons outside our control is not a breach of these Featured Terms.
4. Fees, billing and automatic renewal
- The fee is the monthly price shown when you sign up (currently $39 per month), plus any applicable taxes.
- Fees are billed monthly in advance through our payment processor (currently Stripe) to the payment method you provide. We do not receive or store your full card number.
- Your Featured listing renews automatically each month, and you authorize us to charge your payment method each month at the then-current price, until you cancel.
- If a payment fails, we may suspend Featured placement until payment is made. Your free listing is not affected.
5. Cancellation
- You can cancel at any time, online, by submitting the “Cancel Featured” form at westchesterkidssports.com/contact, or by replying to any billing email from us. If our payment processor offers a self-service billing portal, you may also cancel there.
- Cancellation takes effect at the end of your current paid month. Your Featured listing remains active until then and is not charged again.
- After cancellation your listing returns to a free listing. It stays on the Site unless you also ask us to remove it.
- We will confirm your cancellation by email.
6. Price changes
We may change the monthly price. We will email you at least 30 days before a new price applies to you, and you may cancel before it takes effect.
7. Refunds
Fees are non-refundable and we do not give refunds or credits for partial months, except that: (a) if we decline your request or cannot verify it before activation, we refund any amount paid; (b) if we end your Featured listing without cause, or discontinue the Featured program, we refund the unused portion of any prepaid fees; and (c) we will provide any refund required by law.
8. Your content
- You may provide content for your listing, such as photos, logos, descriptions, age ranges, season details, and links to registration pages (“Advertiser Content”).
- You confirm that Advertiser Content is accurate and lawful; that you own it or have all rights and permissions needed for us to use it; that it does not infringe anyone's rights or make false, misleading or unsubstantiated claims; and that any links are safe and lead where they say they do.
- Photos of children. Do not send us any photo in which a child can be identified unless you have written permission from that child's parent or guardian to use it in advertising. Do not include children's names or other personal information in Advertiser Content. We may refuse any photo of a child without giving a reason.
- You grant us a non-exclusive, royalty-free license to host, reproduce, resize, format and display Advertiser Content on the Site while your Featured listing is active, and for a reasonable period afterwards to remove it (including from routine backups).
- We may reject, edit for length or format, or remove Advertiser Content that we believe violates these Featured Terms or is otherwise inappropriate.
9. Your responsibilities
You are responsible for keeping your listing accurate and for telling us promptly if your program closes, moves or changes ownership. You are solely responsible for your business and the services you provide, including compliance with all applicable laws, licenses and regulations, and for the safety and supervision of the children in your care, background checks, safeguarding policies and insurance. We do not verify any of these.
10. Suspension and termination
We may suspend or end your Featured listing immediately, without refund, if you breach these Featured Terms or the Terms of Use, if your listing or Advertiser Content is inaccurate or misleading, if your payment fails and is not cured, if your program closes, or if your conduct could harm the Site, its users or our reputation. We may also discontinue the Featured program on at least 30 days' email notice, with a refund under section 7(b).
11. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE FEATURED TERMS, THE FEATURED LISTING AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE FEATURED TERMS OR YOUR FEATURED LISTING WILL NOT EXCEED THE FEES YOU PAID US FOR THE FEATURED LISTING IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS OR YOUR INDEMNITY OBLIGATIONS.
13. Indemnity
You agree to defend, indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of your Advertiser Content, your breach of these Featured Terms, or your business and the services you provide, including any claim relating to a child's participation in your program.
14. Relationship
We and you are independent contractors. Nothing in these Featured Terms creates a partnership, agency, franchise or employment relationship, or authorizes either party to make commitments for the other. Featured listings are identified on the Site as paid placements.
15. Changes to these Featured Terms
We may update these Featured Terms. If a change materially affects an active Featured listing, we will email you at least 30 days before it applies to you, and it will take effect from your next billing period after that notice. If you do not agree, you may cancel before the change takes effect.
16. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Westchester County, New York, and you and we consent to their jurisdiction — except that either of us may bring an individual claim in small claims court if it qualifies.
17. Notices and entire agreement
We will send notices to the email address you gave us when you signed up (please keep it current); you can send notices to us through our westchesterkidssports.com/contact page. These Featured Terms, the Terms of Use and the plan and price shown when you signed up are the entire agreement between us about Featured listings and replace any prior discussions. If any provision is unenforceable, the rest remains in effect. You may not assign these Featured Terms without our consent; we may assign them in connection with a sale or transfer of the Site.
